- This programme is offered by Diamonds by Pelvi FZE (or ‘DBP’), and will be known as the ‘DBP Diamond Rewards Programme’ (also referred to as ‘Programme’).
- Clients can sign up for the following four available timelines under the Programme:
3 months, 6 months, 9 months or 12 months. A custom timeline may also be created for a client upon request. Please email dbprewards@diamondsbypelvi.com for arranging a custom timeline.
- Payment Cycle: Under the Programme, clients will be making monthly payments via a payment subscription until their selected timeline ends. The payments under the Programme will have to be made on a selected date of the client’s choosing. Once the payment date is selected, it cannot be changed.
If a payment is missed, a 7-day grace period will be allowed to make the payment. If a member of the Programme still fails to make the payment, they will be removed from the DBP Diamond Rewards Programme and a refund will be processed in accordance with the refund policy mentioned below.
- Minimum spend amount: The total minimum spend amount to register for the Programme (irrespective of Goal timeline) is AED 10,000, exclusive of VAT and Credit Card charges. This can be achieved by purchasing one or more products.
- Gift Card: The Gift Card(s) will only be issued to people aged 18 & over. The Gift Card(s) is a stored value card which allows the clients subscribing to the Programme access to their deposited funds. It does not constitute a checking, savings or other bank account and is in no way connected to any other accounts the clients may have with DBP. The Gift Card(s) is non-transferable and DBP reserves the right to cancel an issued Gift Card at any time and issue a refund in accordance with the “Refund Policy” outlined below. DBP’s decision in such a case will be final and not subject to providing a reason for refusing/not issuing a Gift Card.
Each payment made to DBP under this Programme will be followed by a ‘Gift Card’ being issued by DBP to the client reflecting the payment made. The Gift Card can be utilised on purchase of any Diamonds By Pelvi diamond jewellery products on completion of the goal timeline.
If the client wishes to utilise their Gift Card(s) prior to the completion of their selected timeline, they must inform DBP via email 6 weeks in advance and must comply with the AED 10,000 total ‘minimum spend amount’ requirement. As long as both conditions are met, the clients can leave the Programme whenever they desire. The minimum spend amount can be achieved by:
- Using the cumulative value of the Gift Cards. Any fully unused Gift Card will be refunded to the client as per the refund policy mentioned below.
- A combination of Gift Card(s) value and remaining balance payment via accepted means of payment.
- The client must spend the total cumulative value of all obtained Gift Cards once their goal timeline is complete. However, they do have the option of paying any required additional balance via the accepted payment methods if the selected product value exceeds that of the value of Gift Card(s).
- The Client has their goal timeline plus 60 calendar days to spend the total value of all their Gift Card(s). After the expiration of this timeline, if no action is taken, the total Gift Card(s) value will be refunded as per the refund policy mentioned below.
- Rewards: DBP is pleased to offer their clients rewards to help them achieve their Diamond Goals. Only one reward can be availed at any one time and cannot be used in conjunction with any other active DBP offer.
- When clients spend between AED 10,000 – 15,000, DBP will offer them an additional AED 500 towards their purchase. The minimum limit of AED 10,000 must be crossed in product value, exclusive of VAT and Credit Card charges before the reward can be availed.
- When clients spend above AED 15,000 (product value exclusive of VAT & Credit Card charges), DBP will offer such clients an additional AED 1000 or 2% (whichever of the two is higher) on product value up to a maximum of AED 2,000 towards their purchase.
- Referral Bonus: DBP will offer a referral bonus for an amount of AED 250 to clients who invite other members to be a part of the DBP Diamond Rewards Programme. The Invitee will also receive the same AED 250 bonus to use towards their purchase. The client will receive a bonus for each member they invite (maximum of 4). Both the client and the invitee must comply with the Minimum spend policy.
- Refund Policy
- DBP will issue a full refund of the total accumulated Gift Card(s) value upon request by a client. The amount refunded will be the total Gift Card(s) sum minus any credit charges or invoicing charges incurred by DBP when the payment was made by the client.
- The refund request must be made in advance of completion of the Programme and any payments due within 7 days of the request will still be charged, however will be refunded when final balances are settled. The refund process may take up to 6 weeks before the clients’ money paid under the Programme is reflected in their bank account.
- If the client does not spend the amount accumulated on their Gift Card(s) during their selected timeline plus 60 days, the total Gift Card(s) amount will be refunded in accordance with clause 10.
- The client must complete a KYC and AML check prior to being accepted into the Programme.
- The client must also nominate an individual to receive their refund in case of their death. The identity proof documents of this individual must be submitted at the time of client’s registration to the Programme and proof of death via a death certificate must be provided in order for the nominee to receive the refund. Diamonds by Pelvi will in no way be liable for the funds once the refund has been processed and sent to the nominee.
- Design Fee: For any custom order which involves a design process, DBP will offer 3 iterations prior to programme commencement free of cost for orders valued below AED 20,000. For any design valued at over AED 20,000 a non-refundable design fee of AED 1,500 will be applied with allocation of 5 design iterations prior to programme commencement. Once the programme commences the design fee will be included within the total order value for any order value above AED 20,000.
- Limitations: The Gift Card(s) balance cannot be used to purchase other Gift Cards. Gift Cards cannot be loaded, issued, used for payment outside of DBP or its affiliated properties; used for unauthorised advertising, marketing, sweepstakes, promotional or commercial purposes, including to facilitate the resale or shipment of goods from DBP; redeemed for more than face value; transferred for value; redeemed for cash; returned for a cash refund (except to the extent required by law); or used in a manner otherwise prohibited by these terms and conditions. No portion of a client’s Programme balance can be transferred to another DBP account.
Anyone using a Gift Card issued by DBP agrees to comply with these terms and conditions, and not to use a Gift Card in any manner that is misleading, deceptive, unfair, or otherwise harmful to DBP or its customers. DBP reserves the right, without notice to its clients, to void Gift Cards without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use their services, cancel or limit orders, and bill alternative forms of payment if it is suspected that a Gift Card is obtained, used, or applied to a DBP account (or a client’s Programme balance is applied to a purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.
The risk of loss and title for Gift Cards pass to the purchaser upon DBP’s issuance of the Gift Card to the purchaser or designated recipient, or DBP’s delivery to the carrier, whichever is applicable. Gift Cards must be obtained from DBP and the clients are responsible for safeguarding their Programme balance or Gift Card from unauthorised use. DBP is not responsible if any Gift Card is lost, stolen, or destroyed, or if a client’s Programme balance or any Gift Card is used without their permission. DBP is not responsible for, and assumes no liability for any unlawful conduct or fraud by any third party associated with any Gift Card.
- Limitation of Liability: TO THE FULL EXTENT PERMISSIBLE BY LAW, DBP MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS OR PROGRAMME BALANCE, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, THE CLIENTS’ SOLE REMEDY, AND DBP’S SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT GIFT CARD.
- Disclaimers: DBP shall be absolved of any liability in case:
(a) the clients fail to avail the usage of the Card due to force majeure conditions including but not limited to not being in the required geographical range or any other reason including natural calamities; legal restraints or any technical lapses in the telecommunication network or any other reasons beyond DBP’s actual control. Also DBP is herein absolved of any kind of liability arising due to a loss; direct or indirect incurred by you or any other person due to any lapse in the facility owing to the above-mentioned reasons.
(b) there is loss of any information during processing or transmission or any unauthorised access by any other person or breach of confidentiality;
(c) there is any lapse or failure on the part of the service providers or any third party affecting the usage of the Card (and for this purpose, DBP makes no warranty as to the quality of the service provided by any such provider);
(e) any loss or damage whether direct, indirect or consequential, including but not limited to loss of business, contracts, or goodwill, loss of use or value of any equipment including software, whether foreseeable or not, suffered by you or any person howsoever arising from or relating to any delay, interruption, suspension, resolution or error by DBP in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or message to and from the clients’ telecommunication equipment and the network of any service provider and DBP system or any breakdown, interruption, suspension or failure of the clients’ telecommunication equipment, DBP system or the network of any service provider and/or any third party who provides such services as is necessary to provide.
DBP shall not be involved in or in any way liable to clients for any dispute between you and a cellular services provider or any third party service provider (whether appointed by DBP on that behalf or otherwise).
DBP shall not be held liable for any loss incurred by clients due to use of the Card by any other person with their express or implied permission. DBP shall not be held responsible for the confidentiality, secrecy and security of the personal or account information being transmitted for affecting clients’ instructions.
DBP shall not be held liable for any loss suffered by clients due to disclosure of the personal information to a third party by DBP, for reasons inclusive but not limited to participation in any telecommunication or electronic clearing network, in compliance with a legal directive, for statistical analysis or for credit rating.
- General Provisions: In addition to any general right to set-off or other rights conferred by the law to DBP, the clients agree that DBP may in their absolute discretion at any time and without notice combine and consolidate all or any amounts in any Card of clients’ regardless of currency to set-off or transfer any amount in such Card in or towards discharge of all amounts due to DBP under any Card whether in AED or any other currency and may do so notwithstanding that the balances on such Cards and the sums due may not be expressed in the same currency and the clients hereby authorise DBP to offset any such combination, consolidation, set-off or transfer with the necessary conversion at DBP’s prevailing exchange rates which shall be determined by DBP at their absolute discretion.
No forbearance, neglect or waiver by DBP in the exercise or enforcement of any right or remedy arising from this Agreement will prejudice DBP’s right thereafter to strictly enforce the same.
No waiver by DBP will be effective unless it is in writing.
If any provision in these Terms and Conditions is found to be unenforceable, invalid or illegal, such provision will be deemed to be deleted and the remainder of these Terms and Conditions will be unaffected by such unenforceability, invalidity or illegality.
DBP shall not be liable for their inability to pay due to restrictions on convertibility or transferability, requisitions, involuntary transfers, acts of war or civil strife or other similar causes beyond their control. In such event no other office, branch, subsidiary or affiliate of DBP shall be responsible or liable to the clients.
DBP may assign any of their rights and obligations under the Agreement, without the clients’ prior consent, to any third party, subject to such party continuing the obligations in the Agreement to you. The clients are not permitted to assign their rights and obligations under the Agreement to any third party.
- Dispute resolution: This Agreement and any disputes, which arise under it, shall be governed by the laws of the Emirate of Dubai and applicable federal laws of the United Arab Emirates and is subject to the non-exclusive jurisdiction of the Dubai Courts.
